Senate passes bill that allows transfer of Gitmo detainees to U.S. Mainland

WASHINGTON — President Barack Obama won a modest victory Tuesday in his continuing effort to close the Guantanamo Bay prison in Cuba, allowing the government to continue to transfer detainees at the facility to the U.S. to be prosecuted.

The plan to permit terrorist suspects held at the facility to be shipped to U.S. soil to face trial passed the Senate by a 79-19 vote as part of a larger $44.1 billion budget bill for the Homeland Security Department.

The measure already passed by the House now goes to Obama for his signature. The Guantanamo provision generally tracks restrictions already in place that block release of detainees in the U.S., but permits them to be tried here.

Obama in January ordered the facility closed within a year, but the administration has yet to deliver a plan and the effort has hit several roadblocks. Among the problems is unease among Obama’s Democratic allies on Capitol Hill, who have refused to fund the effort.

The plan adopted Tuesday requires the administration to develop a plan before any further transfers. It also requires 15 days’ notice before a transfer can occur and a certification that the prisoner does not represent a security risk.

The Senate debate over Guantanamo prisoners was relatively sedate. Last week, House Democratic leaders had to press to defeat a GOP effort to block transfer of any of the Guantanamo Bay detainees to the U.S., even to face trial.

“The underlying spending bill also backs the Obama administration’s refusal to release new photos showing U.S. personnel abusing detainees held overseas. The measure supports Obama’s decision to allow the defense secretary to bar the release of detainee photos for three years.

The bill also would extend for three years the E-Verify program, which uses the Social Security Administration database so that employers can verify the immigration status of new hires. A GOP plan to permanently expand the voluntary program and make it mandatory for federal contractors — which passed the Senate in July — was dropped during House-Senate talks.

The E-Verify program is a favorite of lawmakers who prefer an enforcement-first approach to immigration policy. They want to make it mandatory for employers nationwide. But more liberal lawmakers want to pair it with other elements of immigration reform, such as creating a so-called pathway to citizenship for illegal immigrants already in this country.

So once again the Senate Republicans are either outsmarted or outmaneuvered. The White House gets their way again and the door has been opened for the administration will finally be able to bring the Gitmo prisoners to US soil.

First, we need the names of the Republicans who voted for this bill. Then we need to know if any of them read the bill or if they knew it had been buried in the bill and voted for it anyway.

Do the Republicans have any leaders at all? Why would they allow this to happen? Couldn’t they insist that this be made into a separate bill? If not, shouldn’t they have all voted against it on principle? It makes you wonder how much different things would be even if there were more Republicans in the Senate.

I am starting to think the only way we get real change is with a clean sweep and a viable third party – which means real conservatives need to figure out how to get on one page. This is another failure in a growing list of failures where Republicans did not show any backbone and loudly rail against this deception of the public.

Healthcare reform Bill will “collapse the system”

Colorado insurance executives, cautious supporters of health care reform throughout the past year, are now warning that current proposals could cause a “system collapse.”At issue are what insurance companies consider absurdly low penalties for people who choose not to buy health insurance.Their concern: People will buy insurance only when they desperately need it, such as after they’re diagnosed with cancer or heart disease.

Healthy people might choose to pay the penalty, now proposed at a few hundred dollars per year, because it is far less expensive than buying insurance. Insurance companies, under that scenario, would end up spending more to treat patients than they would receive in premiums. Rates would rise even faster than they do now.  

“People would come in, pay premiums for a few months while they were getting their cancer treatments,” said John Martie, president and general manager of Anthem Blue Cross Blue Shield of Colorado. “If enough people did that, the whole system would collapse. “I would hope it wouldn’t get that far. Ultimately, it would lead to rationing of care.”

In the health care bill passed Tuesday by the Senate Finance Committee, adults who do not purchase health insurance would face an excise-tax penalty of $200 a year starting in 2014 and rising gradually to $750 in 2017. The tax would be prorated if an individual has health insurance for part of a year.

The insurance industry incited an immediate and passionate backlash after saying the Senate bill would cause insurance premiums to increase. Critics accused the industry of using scare tactics to derail reform.

Reform advocates say it is farfetched to assume people who can’t afford insurance — and might qualify for government subsidies — would opt to pay a penalty instead. “They are assuming that people would game the system,” said Denise de Percin, executive director of the Colorado Consumer Health Initiative. “They are looking at the worst-case scenario. People aren’t stupid — they are not going to pay a penalty and get nothing,” de Percin said.

Supporters of the legislation from the Senate Finance Committee also point out that the proposed penalty is only a proposal. Congress likely will refine the legislation, aiming to strike the right balance between government subsidies and penalties for violating the insurance mandate. But Ben Price, executive director of the Colorado Association of Health Plans, said the proposed penalty is way off the mark. It is so low, “we can’t really call it a mandate,” he said. “Without a mechanism for enforcement, people will wait until they are sick to get coverage,” Price said. Premiums, he said, would “go up for individuals, small business, everyone. Congress needs to create a strong mandate in order to make an ‘all-in’ system work.”

The Cow Fart Tax……. The next battle in the fight to curb global warming….. Really!

Farting cows and other livestock are a major source of methane emissions into the atmosphere. As a result the EPA is looking for ways to address this greenhouse gas problem. So you won’t be surprised to find out that one of the ways they are considering addressing the problem is through a tax. While I am not sure how this will reduce the gases legislation to impose the tax is working its’ way through a House committee. 

According to Rep. James Sensenbrenner, R-WI., the ranking member of the House Select Committee for Energy Independence and Global Warming, if this bill becomes law it could have a devastating impact on agribusiness. In the absence of a technology based solution for livestock methane emissions the congressman said, “I don’t know if we’re supposed to develop the technology to strap a catalytic converter on the back of a cow”, since a capture and convert strategy would be a more earth friendly solution than a tax, if global warming wasn’t a myth in the first place. (Please see my 4 part series on The Waxman-Markey Climate Change Bill)

In case you are wondering about the cost of livestock farts, the EPA proposal breaks it down like this, $175 a year on every head of dairy cattle in the United States, $80 for beef cattle and $20 per head of hogs. In a recent blog I joked about a methane tax because it seemed so ridiculous, turns out we now live in theater of the absurd. If this bill passes hamburger will replace steak as a luxury item and the price of food will keep going up. Amazing how every “green” initiative has a negative effect on the price of something. President Obama may have promised income tax cuts for 95% of Americans but by the time he is done with his social reengineering, the economy will be in shambles and inflation will be through the roof. Last Fall, as story after story broke during the Obama transition, the media speculated that the administration’s vetting process for appointees might need some fine tuning. Several candidates for Cabinet and other posts were forced to withdraw as unsavory parts of their backgrounds emerged after their nominations were announced. The list of failed nominees includes former NM Gov. Bill Richardson, former Sen. Majority Tom Daschle and Nancy Killefer. 

Turns out their vetting process works just the way they want it to. Since the early failures they added all the riff raff through the backdoor by way of the Czar program. If you look up and down the list of regular appointees and Czars – it is quite a list. It is a list of self avowed radicals and revolutionaries that openly admire their counterparts around the world.

I guess all socialists need a role model.

Smoke & Mirrors… Obama’s Economic Recovery

Yesterday the Dow Jones hit 10,015.86 (+144.8 for the day) and eclipsed the 10,000 threshold for the first time in a year. The Nasdaq also rallied to 2,172.23 (+32.34 for the day). The Dow reached that level on the back by strong earning reports from JPMorgan Chase & Co. and Intel Corp. On the strength of this break through some are suggesting that the economy is on the rebound.

However, here are the facts: 

From the AP: 

  • The Labor Department said Thursday that first-time claims for jobless benefits dropped to a seasonally-adjusted 514,000 from an upwardly revised 524,000 the previous week.
  • The tally of people continuing to claim benefits is to 5.99 million
  • Employers have eliminated a net total of 7.2 million jobs since the recession began in December 2007, sending the unemployment rate to a 26-year high of 9.8 percent.
  • The decline in jobless claims shows companies are cutting fewer workers, though the drop isn’t yet steep enough to signal new hiring

  • RealtyTrac®  the leading online marketplace for foreclosure properties, today released its U.S. Foreclosure Market Report™ for Q3 2009, which shows that foreclosure filings — default notices, scheduled auctions and bank repossessions — were reported on 937,840 properties in the third quarter, a 5 percent increase from the previous quarter and an increase of nearly 23 percent from Q3 2008. One in every 136 U.S. housing units received a foreclosure filing during the quarter — the highest quarterly foreclosure rate since RealtyTrac began issuing its report in the first quarter of 2005.

This may in fact be a sucker’s rally. So far this is a jobless recovery. Currently there are over 15 million people out of work and people are losing their homes at an alarming rate. 

According to former Fed Chairman Alan Greenspan, “my own suspicion is that we’re going to penetrate the 10 percent barrier and stay there for a while before we start down”. “People who are out of work for very protracted periods of time lose their skills eventually,” he said. “What makes an economy great is a combination of the capital assets of the economy and the people who run it. And if you erode the human skills that are involved there, there is a real and, in one sense, an irretrievable loss.” Greenspan also expressed his concern over the growing size of the federal deficit and the federal debt. 

Sen. Jon Kyl, R-Ariz. Appearing on CNN, said Democrats could best help the economy:

  • by supporting targeted tax relief
  • eliminating job killing legislation such as: 
    • the proposed cap-and-trade approach to climate change which will increase energy costs for all employers
    • the health care reform bill which will raise taxes on small businesses 

Don’t fall for the recovery line. We need to remain vigilant and continue to fight for fiscal responsibility. We must shut down the runaway government spending and let the free markets “fix” the economy.

As Thomas Jefferson said, “I sincerely believe… that the principle of spending money to be paid by posterity under the name of funding is but swindling futurity on a large scale.”  And…“With respect to future debts, would it not be wise and just for [a] nation to declare in [its] constitution that neither the legislature nor the nation itself can validly contract more debt than they may pay within their own age, or within the term of 19 years? And that all future contracts shall be deemed void as to what shall remain unpaid at the end of 19 years from their date?”

What the Dems really want to say about Health Care

Yesterday I posted the video of Rep. Mike Rogers of Michigan explaining the travesty of the proposed health care bills. Today, I am posting a video of Robert Reich, former  Secretary of Labor and regular lecturer at the University of California at Berkeley explaining what an honest presidential candidate would say regarding healthcare reform. Sounds like he and Rep. Grayson from FL need to get on the same page.

Plus I am including a video where MN Gov. Tim Pawlenty explains a better approach to healthcare reform.. Watch the videos, they say more than I could possibly write to try to explain the reality about the lie that is healthcare reform.

We need to stop these bills in their tracks! It is time to start over with a common sense approach to reform.
